Digihub Africa is deeply concerned about the ongoing fighting in the East of the Democratic Republic of Congo (North and South Kivu) and its potential escalation of the human rights crisis in the region. We are also concerned about the report of internet restriction, including access to certain social media, such as TikTok and X, which may deepen unreported human rights violations. Access to information in this crisis is more than just a convenience; it can be a lifeline for communication.
The recent Digital Code Law (Law No. 23-010) in the Democratic Republic of Congo guarantees access to digital services & free expression, yet these restrictions undermine those principles, especially:
- Article 3 of the Digital Code guarantees citizens access to digital services and online spaces without discrimination.
- Article 5 underscores the government’s responsibility to promote an open, secure, and inclusive digital ecosystem for all users.
- Article 10 affirms the importance of protecting freedom of expression and access to information in digital environments.
The imposed restrictions counter the international commitments made under the Africa Union Convention on Cybersecurity and Personal Data Protection, which the Democratic Republic of Congo ratified in 2023.
Digital Rights are not separated from human rights. They are essential to their full realization.
